Strata Communities

Proper Strata Governance requires an understanding of a Strata's legal obligations and the expectations of the Strata Community. We help with both. We provide all the services that Strata Law Specialists can provide, including assisting with bylaws, drafting resolutions, providing opinions, chairing meetings, attending hearings and negotiating contracts.

We support the Strata Community by facilitating various formal and informal ways that lead Strata Communities to arrive at consensus. Stratas benefit from our vast experience with diverse Strata Communities. We use that experience to help our Clients build and support the Strata Community they want. Robust and resilient Strata Communities reflect the Owners’ vision while meeting all legal obligations.

Tensions and conflicts are part of healthy Strata Communities. The process of addressing these situations and reaching consensus is what builds and reinforces robust and resilient Strata Communities. Morley Hanson is very experienced in dispute resolution.

We work with Strata Communities to create dialogue, facilitate and participate in mediation and negotiation, and provide valuable assistance with formal dispute processes (CRT, Human Rights Tribunal, Small Claims, Supreme Court, and Court of Appeal). We are very experienced advocates and communicators. A common source of conflict is the obligation of a Strata to repair and maintain property, and we have expertise and experience with that.

When an Owner fails to pay their Strata Fees or a Special Levy on time it creates a burden for all the other Owners. The Strata Property Act provides Stratas with exceptional powers to collect debts from Owners. With that power comes a requirement to follow a strict process. We work with Stratas to make sure that process is followed and the debts are collected.

We routinely work with Banks and Owners to coordinate payment, including when a Bank is foreclosing on a Strata Lot. We conduct lawsuits against Owners for debts and we assist with court-ordered sales of Strata Lots. We are experienced with Judgment Enforcement and assist Stratas that are collecting judgments made by the CRT or Courts. 

Stratas have significant obligations regarding insurance. Those obligations are confusing, particularly when there is damage from the same event to both Common Property and portions of a Strata Lot. When a Strata is dealing with Insurance Issues, they should work with a qualified and experienced advisor. Strata Insurance is very different from other forms of Insurance.

We specialize in Strata Insurance, and our team includes a (former) Chartered Insurance Professional and qualified Risk Manager. We work with Stratas to make sure they receive the benefits of the 2-5-10 New Home Warranty. Our Risk Management program enables Stratas to proactively avoid property damage and legal risks.

Many Stratas choose not to hire a Strata Management Company. We have created a package to specifically support those Stratas in an effecient and cost-effective way. For a flat fee we provide a Guidebook including common templates, assist with the preparation for the AGM, provide a chair for the AGM, draft minutes for the AGM, assist with the preparation of four (4) Council meetings and draft minutes of those meetings.

This provides Stratas twith regular contact and advice from Strata Law Specialists without having to pay for services that the Strata does not need. A benefit of the Self-Managed Partnership Program is it allows us to efficiently provide other services at a reduced cost. 

Robust and Resilient Strata Communities are built on a foundation of shared understanding. Morley Hanson believes that education and access to information is critical. We maintain a publicly available collection of articles and insights. As a service, we lead seminars, make presentations, and coach and mentor. Our audience includes Councils and Owners, Strata Managers, Realtors and other professionals.

We provide this education  in person and electronically and can accommodate any size of audience. Strata Law and Strata Living is complicated. Stratas should work with experienced Strata Law Specialists to improve understanding and reduce the likelihood of conflict from misunderstandings and unreasonable expectations.
